Using Genesize
These terms apply to genesize.io and the Genesize application. Genesize is an unincorporated business. “Genesize,” “we,” “us” and “our” mean the operator of that business, not an incorporated company. You can reach us at andrew@genesize.io.
Participation in the affiliate program is also governed by our affiliate program terms. Affiliate registration does not include a free product plan or trial.
By creating an account or using the service, you agree to these terms. If you do not agree, do not use the service. You must be at least 18 and legally able to enter this agreement. Our privacy policy explains how we handle information; it does not waive any privacy rights.
Genesize helps creators, operators and businesses plan and create digital products, organize expertise, develop drafts and produce exports. An existing audience is not required. A generated plan, course, community or launch asset does not mean that we have launched, hosted, sold or delivered that offering for you.
Accounts and client work
Provide accurate account information, keep your credentials secure and notify us of suspected unauthorized access. Each person should use their own account. You are responsible for activity you authorize and for following the permissions of your plan; this does not remove protections the law gives you for unauthorized activity.
If you act for a business, creator or client, you must have authority to accept these terms and permission to use their information, brand and materials. Manage ownership, approvals and compensation in your own agreement with that person. Genesize does not become a party to that arrangement or grant shared account access merely because you select an operator role.
Your content and AI outputs
You keep your rights in the materials you supply. You give us permission to store, process, transmit, format and display them as needed to deliver, maintain and secure the features you request, including processing by our service providers. This permission does not allow us to sell your private content or publish it as our own.
As between you and Genesize, you may use and commercialize outputs generated for your projects, and we assign any rights we may hold in those outputs to you to the extent permitted by law. This does not transfer third-party rights or ownership of our software, branding or pre-existing materials. AI outputs may resemble other outputs, may not qualify for copyright protection, and are not guaranteed to be unique or free of third-party claims.
Review all output before relying on, sharing or selling it. Check facts, citations, permissions, professional claims, pricing and suitability for your customers. AI can invent or omit information. Opportunity scores, market assumptions and income projections are estimates, not verified research or promises of results. Genesize does not provide regulated legal, medical, tax or investment advice.
You are responsible for products you publish and sell, including your customer contracts, refund terms, taxes, accessibility and fulfillment. Our subscription refund policy does not set the policy for your own customers. Keep independent copies of important work.
Acceptable use
We give you a limited, non-exclusive right to use Genesize for lawful personal or business purposes under your plan. Our application, brand and website materials remain ours or our licensors’ property.
- Do not submit material you have no right to use, infringe intellectual property or privacy rights, impersonate others, or create deceptive, abusive or unlawful content.
- Do not upload malware, attack the service, probe other users’ data, evade plan limits or safety controls, or use automated access that disrupts normal operation.
- Do not resell access to Genesize, share account credentials to bypass plan limits, or copy our software or branding without permission, except where applicable law permits it.
- Do not use generated claims, fabricated testimonials or misleading promises to defraud customers. Follow laws and third-party rules applicable to your use.
Plans and payments
Available features, prices, billing frequency and usage limits are shown with the applicable plan. The currency, final checkout amount and disclosed taxes govern the purchase. Features labeled “Future release” are not currently included as available services.
When you purchase a recurring plan, you authorize the disclosed charge at the start of each billing period until you cancel. Payment is processed through Stripe when checkout is available. You must keep billing information current. We do not automatically charge you for additional usage unless you separately authorize that purchase.
We will disclose changes to recurring prices before they take effect and provide an opportunity to cancel before the new charge, as required by law. We do not offer a permanent free plan. Yearly plans are billed upfront for twelve months at a 20% discount compared with twelve monthly payments. AI credits refresh on your monthly subscription anniversary on both billing options. Each AI action shows its credit cost before you start. Unused credits have no cash value and do not roll over unless the plan expressly says otherwise.
14-day trial
New customers may start one 14-day trial on any plan with a payment method required. The trial includes 30 total AI credits and up to three saved product projects, regardless of the selected plan. Switching plans does not restart the trial or replenish its credits. Your selected plan’s available features apply; Creator and Business trials support email drafts and test sends to your own address, while customer campaigns and automations require the first payment.
Unless you cancel before the trial ends, Stripe charges the disclosed monthly price or full annual price, plus applicable taxes, and the subscription renews until canceled. Your first successful payment starts the paid plan’s credit allowance. Cancel through Plans & billing. Previously purchased customer resources remain accessible under their existing purchase terms. Returning customers may subscribe without another trial.
No-refunds policy
No refunds. All purchases and subscription payments are final and non-refundable.
This applies to initial purchases, renewals and any separately purchased credits or add-ons. We do not offer discretionary refunds, monetary account credits or prorated refunds for unused time, unused AI credits, a change of mind, dissatisfaction with AI output, or cancellation partway through a billing period.
When an AI action fails because of a system error, its reserved AI credits are returned to your usage balance. This is a usage correction and does not refund a subscription payment. Retrying reserves the same amount again.
Cancelling stops future renewals; it does not automatically refund a payment already made. You can cancel a trial in Plans & billing before its end date to avoid the first charge.
Nothing here excludes mandatory rights concerning defective or misdescribed services, statutory cancellation or withdrawal rights, unauthorized charges, or other remedies that cannot legally be waived. Merely accessing Genesize does not waive a statutory withdrawal right. We will correct duplicate or erroneous charges where appropriate. For a billing error or a legally required remedy, contact andrew@genesize.io with your account email, payment date and a description of the issue; do not send full card details.
Cancellation and access
Cancel before your next renewal using the subscription-management option in Plans & billing or the billing portal, where available. If you cannot access that option, email andrew@genesize.io before renewal and ask us to cancel. Keep the cancellation confirmation. Simply stopping use, signing out or deleting browser data does not cancel a subscription.
Ordinary cancellation takes effect at the end of the current paid period, with access continuing until then unless a different lawful arrangement is confirmed. Any statutory cancellation right follows its own applicable rules. Account closure and deletion requests can be made through support; export work you want to retain first.
We may restrict or suspend access for nonpayment, a material breach, a security threat or a legal requirement. Where reasonably possible, we will explain the issue and give an opportunity to resolve it. Urgent security or legal situations may require immediate action. Any refund or other remedy required by law remains available.
Ending access does not transfer ownership of your work to us. Provisions that need to continue, including outstanding payment obligations, content rights, lawful liability limits and dispute terms, continue as appropriate.
Service limitations and liability
Features may change and third-party services may experience outages. We do not promise uninterrupted access, a particular business result, or that every generated draft will meet your requirements. To the extent permitted by law, the service is provided as available without additional implied warranties. This does not exclude statutory warranties or a service standard the law requires.
To the extent permitted by law, we are not liable for indirect or consequential loss, lost profits or lost business opportunities. Our total liability arising from the service is limited to the greater of CAD $100 or the amount you paid Genesize in the 12 months before the event giving rise to the claim.
These limits do not apply to fraud, willful misconduct, or any liability or remedy that applicable law does not allow us to exclude or limit. You remain responsible for loss caused by your unlawful use or infringement of others’ rights, subject to applicable law. No term requires you to indemnify us for our own misconduct.
Applicable law and disputes
These terms are subject to applicable law, including any mandatory protections that apply where you live. Disputes may be brought before courts with lawful jurisdiction, without restricting any right you have to bring a claim in a forum available under mandatory law.
You can contact us first to seek a practical resolution, but doing so is not a condition of exercising legal rights. These terms do not impose mandatory arbitration or waive a consumer’s right to seek an available legal remedy. If a provision cannot be enforced, the remaining terms continue to the extent lawful.
Changes and contact
We may update these terms as the service changes. We will post the revised date here and give reasonable advance notice of material changes through the service or email, obtaining agreement where required. Changes will not retroactively remove an accrued right. If you do not accept a future change, you can stop using the service and cancel future renewal, subject to rights already arising under your existing agreement.
Questions about these terms, subscriptions or privacy can be sent to andrew@genesize.io or through Contact us.
